Responsible creator tools are part of the product

What changed: TikTok replies are public, you are responsible for the tools and keys you connect, and fees and plan limits are on the Pricing page.
Loresta is a service operated by Michael Ngo, a sole proprietor. In these terms, “Loresta,” “we,” “us,” and “our” refer to Michael Ngo doing business as Loresta.
Eligibility and authority
You must be at least 18 years old and own or be authorized to operate every connected account and creator storefront. You remain responsible for profile information, approved links, offers, gifts, fulfillment, replies, and platform compliance.
Prohibited use and content
Do not use Loresta for unsolicited bulk messages, harassment, deception, unlawful material, exploitation, impersonation, evading platform controls, or goods and services prohibited by Loresta or its payment providers. Stripe-connected Pages are limited to safe-for-work creator benefits and tips tied to content already provided. Adult or sexually explicit content or services, adult live chat, personal or peer-to-peer transfers, charitable donations, misleading offers, and in-person sexual or dating services are prohibited. We may remove an offer, pause checkout, reverse approval, or suspend a storefront when required for safety, compliance, payment-provider rules, elevated disputes, or fraud risk.
Assist and automation
You choose whether Loresta waits, drafts, sends approved routine replies, or operates in a disclosed autonomous mode. You must configure and review facts, tone, destinations, and boundaries. Loresta may block, pause, or hand off actions that are personal, sensitive, unsupported, ambiguous, or outside an approved policy. You must not use Assist to falsely claim that the creator personally typed an automated message or to conceal an assistant notice when the selected mode requires one. TikTok replies are posted publicly as comments. You’re responsible for what’s posted from your account. You’re responsible for tools and keys you connect.
Storefronts, review, and fulfillment
Loresta sells Creator Page purchases as the merchant of record: the supporter pays Loresta, and Loresta pays the creator their share. The creator provides the described benefit and is responsible for accurate descriptions, lawful fulfillment and supporter communication. Every Creator Page with paid offers is subject to Stripe verification of the creator’s payout account and Loresta commerce review before checkout is activated, and approval may be revisited after material catalog changes. Stripe may require additional identity, tax and bank information at any time. Purchases made before September 29, 2026 as direct charges on a creator’s own Stripe account remain governed by the terms in effect when they were made, under which the creator was the seller.
Tax and regional availability
Loresta calculates, collects and remits the sales tax, VAT or GST that applies to supporter purchases where Loresta is required to. Tax is added at checkout on top of the listed price and is not part of the creator’s share. Supporters can buy from the countries offered at checkout, and creators can receive payouts in the countries offered in payout setup; both lists are limited and may change. Creators remain responsible for income tax and any other taxes on their own earnings. Loresta may file tax information returns, such as Form 1099-K or 1099-NEC, where required and may ask for tax information to do so. These terms are not legal or tax advice.
Tips, refunds, and disputes
A creator tip must relate to content or a service already provided and is not a donation or personal money transfer. Supporters should contact support@loresta.co with the receipt information when a benefit is not delivered, a charge is duplicated, or a refund is requested. Loresta aims to acknowledge a complete request within 2 business days. Refund eligibility and creator review timing depend on the described benefit, fulfillment, applicable law, and payment-provider rules. After an approved refund is submitted to Stripe, it usually appears within 5–10 business days, depending on the supporter’s bank. When a purchase is refunded, the creator’s share of the refunded part is taken back from their payout balance. While a chargeback is open, or if it is lost, the creator’s share of that purchase is taken back; if Loresta wins it, the share is paid again. If a creator’s payout balance cannot cover an amount taken back, Loresta deducts it from the creator’s next earnings. Loresta may pause checkout or payouts and request evidence needed to resolve elevated fraud or dispute risk.
Receipts, payouts, and reporting
Loresta issues the receipt for each Creator Page purchase, and supporters’ card statements show Loresta with the creator’s name. After a payment, Loresta sends the creator’s share to their Stripe payout account; Stripe pays it out to their bank on a monthly schedule and controls payout accounts and provider statements. Creators remain responsible for their own books, tax returns and records. Loresta records transaction references, refund and dispute status, and creator-facing summaries but does not replace a creator’s accounting or tax adviser.
Your content and permission to operate the service
You keep ownership of content you provide, including profile material, images, files, offers, and messages. You grant Loresta a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, and distribute that content only as needed to operate the features you use, including your public Page, benefit delivery, and replies you authorize. Loresta may permit its service providers to do those things only on its behalf. This licence does not permit selling your content or using private messages in advertising. You must have the rights and permissions needed to provide the content and authorize these uses.
The licence ends when the content is removed from the service, except for copies retained for the limited legal, security, payment, and backup purposes described in our Privacy notice. Content already delivered to a supporter may remain with them. Optional voice learning uses creator-authored sent replies and does not store raw history as training material. Copyright concerns can be reported through our copyright reporting page.
Billing and fees
Paid workspace plans renew according to the terms shown at purchase. Each sale has Stripe processing (card fee plus 0.5% sales-tax handling, and Stripe Billing’s 0.7% on memberships) and Loresta's Page fee. If a sale is refunded, Stripe keeps its processing fee, so it isn't returned to you. Dispute fees are deducted from your payouts and returned if you win. See the Pricing page for fees and plan limits. Additional-reply billing is optional and starts only after the workspace owner enables it.
Plan renewal, cancellation, and refunds
Paid workspace plans renew automatically at the end of each billing period at the price and interval shown at purchase, until you cancel. You can cancel at any time in the billing portal in your dashboard; no call or email is required. Cancellation stops the next renewal, and you keep paid access through the end of the period already paid for. If you are not satisfied, you can request a full refund of a plan charge within 14 days of the purchase or renewal, with no reason needed; ask through the receipt link from Stripe or email support@loresta.co with the receipt information, and we aim to respond within 2 business days. After 14 days we do not prorate or refund the unused part of a period, or usage already consumed, except for duplicate or mistaken charges, where a Loresta error caused the charge, and where the law that applies to you requires a refund or a statutory cancellation right. Approved refunds return to the original payment method, usually within 5–10 business days. Refunds for supporter purchases from a creator follow the Tips, refunds, and disputes section above.
Taxes on Loresta plans
Loresta workspace plans are sold through Stripe’s Managed Payments, in which Stripe (through Link) is the merchant of record for the plan purchase. Your checkout, receipt, invoice and card statement may show “Sold through Link” or LINK.COM*, and Stripe sends receipts and handles payment support, fraud checks and payment disputes for that purchase. Plan prices are shown before any applicable sales tax, VAT, GST or similar transaction tax unless the checkout says otherwise; Stripe calculates and collects that tax from your billing location at checkout, and remits it where required. This applies only to Loresta plans. Loresta is the merchant of record for current Creator Page purchases, as described above. You are responsible for any tax that Stripe does not collect from you.
Service changes and suspension
We may change or discontinue unsupported features, and we may pause access needed to protect users, connected platforms, payment providers, or the service. We cannot guarantee uninterrupted provider APIs, checkout availability, payouts, or message delivery.
Service warranties
To the extent permitted by applicable law, Loresta is provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted or error-free service, accurate AI output, any level of earnings, or availability of third-party services. Review generated answers and the policies you approve. This disclaimer does not remove any warranty, remedy, or consumer right that applicable law does not allow us to exclude, or change our stated refund and payment obligations.
Limits on liability
To the extent permitted by applicable law, Loresta is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or business opportunities arising from use of the service. Loresta’s total liability for claims arising from the service is limited to the greater of US$100 or the Loresta service fees you paid during the 12 months before the event giving rise to the claim.
These limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that applicable law does not allow us to limit. They do not reduce refunds due under these terms or law, amounts owed to creators or supporters, or mandatory consumer remedies.
Third-party claims involving creator activity
If you use Loresta for your business as a creator, to the extent permitted by applicable law you agree to indemnify Loresta for reasonable costs, damages, and legal fees arising from a third-party claim caused by your unlawful content, infringement of another person’s rights, or material breach of these terms. This obligation applies only to the extent the claim is attributable to your conduct; it does not cover Loresta’s own misconduct or breach. We will notify you promptly of a claim, allow you to participate in its defence, and will not agree to a settlement requiring you to pay or accept an obligation without your consent. This section does not apply to supporters buying for personal use.
Governing law and consumer rights
These terms are governed by the laws of the State of California, United States, and disputes are heard in the state or federal courts located in Monterey County, California, except that this does not limit any mandatory consumer-protection rights you have under the law of the country where you live, or your right to bring a claim in your local courts where that law provides it.
